The purpose of this document is to define the requirements and conditions to purchase(BUYER) a puppy from J. Robinson(SELLER).  Signature of this agreement in no way prevents either party mutually to cancel the sale of a puppy.


We require that you take your puppy to a licensed veterinarian within 72 hours of receiving your puppy to insure the good health of your puppy to everyone's satisfaction.  If a problem is found a second opinion from our veterinarian to confirm the problem will be procured.  After confirmation of the problem the puppy will be replaced.  If there are no puppies available, one will be provided from the next available litter whelped.  If for any reason you cannot meet this time requirement you are to make arrangements beforehand of both parties.  Puppy must be picked up after 6-8 weeks of age.  If the puppy is diagnosed or dies from a genetic disorder within the first year, Emerald Coast Schnauzer will provide a replacement puppy.  To qualify for this, you must have kept the puppy under the care of a licensed veterinarian.  To make a claim, you must bring a certificate from the veterinarian stating the cause of death or evidence of the genetic disorder and a copy of ALL of your puppy's health records.  Our veterinarian will review and correspond with your veterinarian with the findings.  If both parties are satisfied with the claim, then a replacement puppy will be furnished.  If there are no puppies available, one will be provided from the next available litter whelped.  All shipping charges will be the responsibility of the purchaser.  No refunds will be given for the puppies or the shipping.  This contract applies only to the original dog, not to any replacement.

Because of factors outside the control of the Breeder, no guarantee is made regarding allergies, teeth, volvulus, skin or coat conditions, or immune system problems.  In such situations, the Buyer must work with the Breeder to resolve complaints or concerns.


There are no guarantees that the dog will be successful in breeding, showing or working, and this health guarantee will not apply to a female dog once she has been bred due to the impact breeding has on a female's health.


All payments related to the purchase of a puppy must be received prior to deliver of puppy.  There is a $200.00 to $250.00 nonrefundable deposit to hold any puppy (depending on price of the puppy).  Payment plan will be agreed by both parties and will be expected to be met in full before registration papers will be released.  There will be no refunds on any purchases, shipping charges, or deposits.  There will be an additional $10.00 charge for any late payment and a $45.00 charge for any returned check.


Buyer and Seller agree to mediate any dispute or claim arising between them out of this Contract before resorting to arbitration or court action.  Mediation fees, if any, shall be divided equally among parties involved.  If, for any dispute or claim to which this paragraph applies, any party commences an action without first attempting to resolve the matter through mediation or refuses to mediate after a request has been made, then that party shall not be entitled to recover attorney fees, even if they would otherwise be available to that party in any such action.  If either Buyer or Seller takes any legal action to enforce any part of this Contract, action shall be initiated in the county of Seller's residence and any legal fees and court costs shall be the responsibility of the party found to be at fault.


This contract contains the entire agreement between the parties and no statement of verbal agreements made by either party that are not contained in this written contract shall be valid or binding, unless they occur after the date of the contract and are recognized and accepted by all parties.  This Contract may not be modified or altered except in writing and signed by both parties.  Violations of this Contract will constitute BREACH of CONTRACT.


This contract is under the jurisdiction of the State of Alabama, or in the current county of residence of the Seller at the time of litigation.
